How do the changes affect my business?

Measurement Canada is preparing to introduce new legislation which puts certain mandatory requirements on owners and operators of legal for trade weighing equipment.

The weights and measures laws have been amended and government inspections to re-certify trade machines will no longer be a voluntary option in certain market sectors.

Legal responsibility

If your weighing equipment is used for trade transactions in any of the following 8 Market Sectors:

• 01 Fish & Fishing Products,
• 02 Logging, Forest & Forestry,
• 03 Grain & Field Crops,
• 05 Mining & Metals Industry,
• 06 Downstream Petroleum,
• 15 Dairy Sector,
• 18 Retail Gasoline,
• 22 Retail Food.

..then there will be mandatory requirements to have your scales re-certified periodically.

Risk from non-compliance

If your weighing machine is due for re-certification, and you do not have it carried out, then you could be liable for prosecution with court-imposed fines of:

• up to $10,000 (from $1,000) for a minor offence,
• $25,000 (from $5,000) for a major offence,
• a new fine of up to $50,000 for repeat offences,
• and the introduction of administrative monetary penalties (AMPs) to ensure appropriate deterrence against measurement inaccuracy.
